How to Search Berrien County Criminal Court Records
There are three ways to get Berrien County criminal court records: online search, in-person visit, or a mail request. Online is the fastest way to find basic case data. In person gives you access to the full file and certified copies right away.
The state's free online case search is available at MiCOURT Case Search. You can look up cases by name, case number, or attorney. MiCOURT shows party names, docket entries, hearing dates, and case status. Not every piece of the file shows up online, but it is a good place to start before visiting the courthouse.
The Berrien County website has details on how to request court records. The Public Records page explains what is available and how to submit your request. For specific criminal division procedures, the Criminal Division page has contact information and guidance.
The Criminal Division page above shows how Berrien County organizes its court services. Use it to find the right phone extension and understand what types of cases the division handles before you call or visit.
To search in person at the St. Joseph courthouse, bring a photo ID and the name or case number you need. Staff at the clerk's window can search by name and pull up cases. Certified copies take a bit longer to prepare, so plan for extra time if you need them that day.
For mail requests, download the Court Records Request form from the county website. Send it to the County Clerk at 811 Port Street, Room 123, St. Joseph, MI 49085. Include payment and a self-addressed envelope if you want documents returned by mail.

Berrien County charges standard fees for criminal court record copies. The fee for a record check is $10 per individual. Copies are $1 per page. Certified copies cost $11 for the first page and $1 for each page after that.
Pay by check or money order when submitting mail requests. In-person payments may accept cash. If you are not sure of the total before visiting, call the clerk at (269) 983-7111, Ext. 8368 to get an estimate. The clerk's office can tell you how many pages are in a file before you commit to the copy cost.
Under Michigan FOIA law (MCL 15.231), fee waivers are available if you qualify as indigent or if the release serves public interest. Submit a written request for a waiver along with your record request. The first $20 of qualifying fees may be waived under MCL 15.234.
Note: Certified copies cost more than plain copies. Use plain copies for research and certified copies only when required by another agency or court.

Online Search Tools and Resources
Michigan offers several online tools to help you find criminal court records without a trip to the courthouse. The main statewide tool is MiCOURT Case Search. It is free and covers most counties in the state, including Berrien County. You can search by name, case number, or other identifiers to get basic case details.
For a broader criminal history search, the Michigan State Police runs the ICHAT system. ICHAT searches the state's criminal history database by name. It costs $10 per search and requires registration. Results show arrests and convictions from participating agencies. ICHAT is a name-based search and does not use fingerprints, so results may miss some records or include people with similar names.
Michigan also has an e-filing system called MiFILE. Attorneys and parties can file documents and access certain case records through this system. Check the MiFILE available courts list to see if Berrien County courts are participating in e-filing.
The Michigan Legal Help website is another useful resource. It has plain-language guides on how to read court records, what different document types mean, and how to work with the clerk's office.
FOIA vs Court Records in Berrien County
People sometimes confuse FOIA requests with court record requests. They are not the same thing in Michigan. Court case records are governed by Michigan Court Rules (MCR 8.119), not the Michigan Freedom of Information Act. You request court files directly from the Clerk of the Court, not through a FOIA form.
FOIA applies to other government records, like police incident reports, arrest reports from the sheriff's department, or records held by county agencies that are not part of a court file. To get police records in Berrien County, you would submit a FOIA request to the relevant law enforcement agency. The Michigan State Police FOIA portal is at michigan.gov/msp/services/foia.
Criminal history records from ICHAT are governed by MCL 28.241a. That statute defines what a criminal history record includes and who can access it. Court case records held by the clerk are separate from the state police database. You may need both sources to get a complete picture of someone's criminal history.
Note: If you want records of an ongoing investigation, those are generally exempt from both court access rules and FOIA until charges are filed.
